Dont know if this has been mentioned,but the question is this....Does the utility your around let others lease their easements to others ,such as people who own horses /ect?Allowed or not....the strangest thing Ive seen in a highline easement was a tennis court which was behind a home,,,right in the middle of the easement between the towers.

Reppy; like any other legal document easements vary all over the place as to what they do or do not allow. Another variation is some right of ways are on purchased land owned by the utility but most are just an easement on land owned by someone else. Most easements do not allow permanent structures other than fences to be built across the easement, but like I said a lot of variations. The other problem a lot of people build in a easement that they should not have and the only recourse Utility has is to go to court. Still another variation; our easements cover ourselves and any communication company operating under a Public Utility license (Phone Company) but it does not cover Cable TV companies because they do not have a Public Utility License. Like anything else done by Lawyers confusion is rampant.
